Bonds and companies and what is legally right and wrong PART 1 [A summary from Labour Law Advisor video]

1. Bonds are not illegal. Infact it is an assurance used by government offices too.

2. No bond can bind you to stay at job, it violates

3. Companies can ask for compensations against breaking the bond but not the whole sum as penalty, if Companies force penalties then it can take upto civil case and not criminal case. In which neither of you are charged with police case.

4. If the company asks for blank cheques then don’t give it, as they might use it to get the money, and if you don’t have enough money in bank or your sign is fake then the case will turn to Criminal charges and you will be charged with case of forgery, ID Theft and fraud. These can be charged if the cheque is bounced for any reason. As blank cheques are considered for debt gurantee and faliure to pay debt is a serious crime. Here company doesn’t have to prove that cheque is genuine debt gurantee or something but you have to prove why the cheque was given.

5. It is not illegal to ask for original documents for verification. But for verification only and not as a gurantee. If you have given any original documents as a gurantee then it violates your right to earn when you leave the company if they refuse to give it back.

6. Once you leave the company and if you get a legal notice for breaching bond, then you have to reply within 15 days after you receive it. Else this can take up for another civil charges against you and you will lose the case for sure as you are held responsible for not replying it. It is adviced to reply to any legal notice within specified time. You will get 3 notices within 15 days.

7. If in any case you lose in district court then you can’t appeal against the judgment to high court until you have paid court fees at district court.

8. Companies cant add the amount of your hiring rounds into the compensations.
